Since April 1998, GPs occupying leasehold premises have been eligible for financial assistance towards the costs incurred in surrendering or assigning a lease on unsatisfactory premises, or even continuing payments on premises vacated in order to move to suitable alternative premises.
These reimbursements at the health authority's discretion are only made if:
the unsatisfactory premises are owned by a third party, excluding those in which the GP or close relative has an interest
the GP agrees to move to suitable alternative premises accepted by the health authority for reimbursement under the rent and rates scheme
The actual costs reimbursed include any of these expenses if they have, or will have been, properly and actually incurred:
· the cost agreed with the landlord to surrender the lease or the cost of assigning the interest in the property
· reasonable legal costs
The health authority may agree to reimburse all or part of the costs arising under the lease in order that the GP may move to other suitable premises if:
· a 'surrender' cannot be agreed with the landlord
· an 'assignment' to another party is not possible
· the district valuer considers that neither surrender nor assignment are cost effective
· no more than 5 years of the current lease remains
· it is satisfied that the GPs had taken and are continuing to take reasonable steps to surrender or assign their interests in the property
